1. Merchant Identification
RemoteWP is provided by X-House SRL, legal entity headquartered in Arad, Str. I.C. Bratianu no. 3, registered with the Trade Register under J02/762/2002, VAT ID CUI RO14900053. Business contact: info@remotewp.dev.
2. Applicable Law
Customer relationships are governed by applicable Romanian and EU legislation, including consumer rights, e-commerce, data protection, and tax rules, as relevant.
3. Orders and Payment Obligation
By placing an order, the customer acknowledges a payment obligation. Before checkout completion, pre-contractual information is provided, including product details, total price, and key legal terms.
4. Digital Delivery
RemoteWP products are digital goods/services (license access, downloads, activation, updates) and are delivered electronically.
5. Pricing and Invoicing
Prices and commercial terms are displayed at checkout. Invoicing is issued under applicable fiscal and accounting rules.
6. Withdrawal and Refunds
Consumer withdrawal rights and digital content exceptions are described in the Refund and Return Policy.
7. License Scope
Licenses are non-exclusive and non-transferable unless explicitly stated otherwise. Unauthorized copying, resale, or misuse of software assets is prohibited.
8. Third-Party AI Systems and Output Risk
RemoteWP may be used together with third-party AI tools and agents (for example coding assistants or autonomous workflows) that are not owned or controlled by X-House SRL. AI output is inherently probabilistic and may be inaccurate, incomplete, insecure, or harmful in specific environments. The customer remains solely responsible for prompt design, agent configuration, model selection, approval flows, execution decisions, and all changes applied to their infrastructure.
9. Customer Safeguards (Mandatory)
Before any write operation, customers must maintain tested backups and restore procedures, use staging/testing where possible, apply least-privilege path restrictions and token controls, and require human review before production deployment. Failure to implement these safeguards is treated as customer-side operational risk.
10. Data Alteration and Security Disclaimer
To the fullest extent permitted by law, X-House SRL is not liable for data alteration, corruption, deletion, downtime, or security incidents caused by: (a) third-party AI/agent errors or autonomous actions, (b) incorrect customer configuration or instructions, (c) unauthorized use of tokens or credentials, (d) hosting/server or third-party software failures, or (e) customer deployment of unreviewed code changes.
11. Warranty and Service Basis
Unless otherwise required by mandatory law, the service is provided "as is" and "as available". X-House SRL does not warrant uninterrupted availability or error-free operation across all customer stacks and integrations. Statutory non-waivable rights remain unaffected.
12. Limitation of Liability
To the maximum extent allowed by applicable law, X-House SRL excludes liability for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business, or loss of data. Aggregate liability for direct damages related to RemoteWP is limited to the total amount paid by the customer for the relevant service in the 12 months preceding the event giving rise to the claim. This limitation does not apply where liability cannot be limited under mandatory law (including fraud or willful misconduct, and other non-excludable categories as applicable).
13. Indemnification
The customer agrees to defend, indemnify, and hold harmless X-House SRL against third-party claims, losses, and costs arising from customer misuse, unlawful processing, unauthorized access enabled by customer security failures, or deployments performed based on customer-controlled agent workflows.
14. Complaints and Disputes
Please send complaints first to info@remotewp.dev for amicable resolution. If unresolved, customers may use competent consumer protection channels and courts with jurisdiction under Romanian law.
15. Updates
These Terms may be updated to reflect legal, technical, or business changes. The version published on this page is the applicable version.
